TENTATIVE

Expedited Petitions to Approve Minor's Compromise are denied. OSC re dismissal for failure timely to bring to trial within three years and five years (CCP 581(g), 583.310, 583.360, 583.410 and 583.420(a)(2)(A)) are set in 35 days. Clerk to give notice.

DISCUSSION 

The Plaintiff has been seeking to perfect its petitions to approve minor's compromise since July 2022, when Petitioner incorrectly filed an expedited petition although a regular petition was required. As late as September 20, 2023, the Court's minute order reflects another continuance of the hearing on the petitions so that Petitioner can correct deficiencies. The Court described those deficiencies and continued the matter almost 60 days for Plaintiff to file the corrections. Counsel filed paperwork two days before the hearing again as an expedited petition.  An expedited petition is not allowed because the total settlement is over $50,000.
