Summary

 

On 11/24/151, Plaintiff HOT SHOT HK, LLC filed a Complaint alleging that attorney defendants DARTUSH G. ADLI, DREW SHERMAN and HANWET CHENG, were negligent in their representation of plaintiff in connection with a copyright dispute. The cause of action is LEGAL MALPRACTICE.

Moving parties request the Court to confirm an arbitration award of the AAA, on grounds including the following:  

 

·         An arbitration award has dismissed the arbitration, because Claimant (Plaintiff in this action) had over five years from the time this matter was compelled to Arbitration to take action to initiate such Arbitration, and did not.

·         Claimant was hereby ordered forthwith to reimburse Respondents (Petitioners in this petition) for the arbitration fees and costs that they advanced on behalf of Claimant, in the amount of $8,043.75.

·         In July of 2013, Plaintiff and Defendant had entered into a written Engagement Agreement relating to certain professional legal services.

·         The Engagement Agreement contains an arbitration clause, at paragraph 12, which requires disputes between the parties arising out of the performance of legal services be resolved through binding arbitration proceedings.

 

Tentative Ruling

 

The unopposed petition is granted.

The Court confirms the arbitration award as made.

Unless a petition or response seeking to correct or vacate an arbitration award was filed properly based upon valid grounds, or the proceeding is dismissed, courts are required to enter judgment in conformity with the award.  Valsan Partners Ltd. Partnership v. Calcor Space Facility (1994) 25 Cal.App.4th 809, 818.
