The unopposed motion to enforce the settlement agreement is GRANTED, subject to plaintiff providing proof on or before that hearing that defense counsel was served with the moving papers or that the parties' settlement agreement authorizes notice in the manner provided. See Code Civ. Proc. § 1015.

The proof of service only shows service on defendant's registered agent. ROA 207.

Turning to the merits, plaintiff has satisfied the statutory requirements of Code of Civil Procedure section 664.6. While the litigation was pending, the parties entered into a written settlement agreement and then filed a stipulation requesting that the court retain jurisdiction pursuant to section 664.6. (See Rastegar Decl., ¶¶ 3-6.) Accordingly, the court will sign the proposed judgment (ROA 211) submitted with the moving papers.
