A. Plaintiff/Cross-Defendant Neal Electric Corp.'s motions to compel further responses to special interrogatories and requests for production of documents are DENIED as moot. Supplemental responses have been provided. (Thornton Decl., ¶ 10.) Any challenge to the sufficiency of the supplemental responses must be resolved by future motion.
B. Neal's request for monetary sanctions is granted in the reduced total amount of $2,012.50 (3.5 hours at $575 per hour). 'The court may award sanctions under the Discovery Act in favor of a party who files a motion to compel discovery, even though...the requested discovery was provided to the moving party after the motion was filed.' CRC 3.1348(a). The sanctions must be paid by defendant/cross-complainant Peter Vander Werff Corporation to plaintiff/cross-defendant Neal Electric Corp. by June 14, 2024.
C. Neal's requests for judicial notice (ROA 93, 99) are denied as unnecessary to the resolution of these discovery motions.
