A. Defendant's motions to compel further responses to form interrogatories, special interrogatories, and requests for production of documents are DENIED as moot. Verified supplemental responses have been provided. (Grigoryan Decl., ΒΆ 8.) Plaintiffs were not required to supplement their response to form interrogatory 2.8 because defendant did not move to compel a further response to that interrogatory.
See ROA 42, 49. Defendant's arguments regarding the sufficiency of the supplemental responses must be resolved by future motion.
B. Defendant's request for monetary sanctions for all six motions is granted in the reduced amount of $1,400 (4 hours at $350 per hour). 'The court may award sanctions under the Discovery Act in favor of a party who files a motion to compel discovery, even though...the requested discovery was provided to the moving party after the motion was filed.' CRC 3.1348(a). The sanctions must be paid by plaintiffs Oscar Leonel Ruiz and Maria G. Lopez Ruiz, jointly and severally, to defendant American Honda Motors by January 19, 2024.
