The demurrer to the complaint is SUSTAINED without leave to amend.

A. Defendant's request for judicial notice is granted. Evid. Code § 452(c), (d).

B. Turning to the merits, the court deems the lack of opposition to the demurrer to be a concession as to the merits of the demurrer. SDSC Local Rule 2.1.19(B). Moreover, the court finds that plaintiff has failed to state facts sufficient to constitute a cause of action for any of the challenged claims. Code Civ.

Proc. § 430.10(e). As currently pled, counts 1, 2, 3, 4, 5, 6, 7, and 9 are time-barred (Gov. Code § 12965(c)(1)(C)), and count 10 lacks specific facts showing 'extreme' and 'outrageous' conduct (Vasquez v. Franklin Management Real Estate Fund, Inc. (2013) 222 Cal.App.4th 819, 832).

C. Defendant must file and serve an answer to the complaint, exclusive of the dismissed claims, by November 20, 2023.
