Plaintiff's motions to compel defendant XL Staffing to provide further responses to special interrogatories and requests for production of documents are DENIED as moot. Supplemental responses have been provided. (Horner Decl., ΒΆ 7; Ex. C.) Plaintiff's request for monetary sanctions is granted in the reduced total amount of $945 (3 hours at $275 per hour plus $120 in filing fees). 'The court may award sanctions under the Discovery Act in favor of a party who files a motion to compel discovery, even though...the requested discovery was provided to the moving party after the motion was filed.' CRC 3.1348(a). The sanctions must be paid by defendant XL Staffing to plaintiff Marie Washington by April 12, 2024.
In issuing this ruling, the court has exercised its discretion to consider the late-filed opposition papers.
