A. Plaintiffs' unopposed motions to compel responses to form interrogatories and for deemed admissions are GRANTED.
On September 26, 2023, plaintiffs served form interrogatories – construction litigation and requests for admission on defendants. (Sabban Decl., ¶ 1.) No responses have been received to date. (Id. at ¶ 2.) Accordingly, defendants must serve verified responses without objections by April 5, 2024. Code Civ.
Proc. § 2030.290(a). In addition, the truth of any matters specified in the requests for admission are deemed admitted. Code Civ. Proc. § 2033.280(b).
B. Plaintiffs' request for monetary sanctions is granted in the reduced total amount of $1,004.32 (2 hours at $425 per hour plus $154.32 in costs). The sanctions must be paid by defendants Ahmed C.
Perez and Carolina Perez Chavez a.k.a. Carolina Perez, jointly and severally, to plaintiffs Benjamin E.
and Sharon B. Jenkins by April 19, 2024.
