The unopposed motion by petitioners Nancy Ann Jennings and Don Michael Jennings for an order on unlawful use of personal identifying information is GRANTED.
As an initial matter, the court finds that the instant motion hearing meets the requirements of the order to show cause procedure described in Civil Code section 1798.201.
Turning to the merits, the court concludes that the petition is meritorious and there is no reasonable cause to believe that petitioners' residential address was used lawfully in the business entity filing attached as Exhibit 1 to the petition. The court therefore finds that petitioners' residential address has been used unlawfully. Civ. Code § 1798.202(b).
The court will sign the proposed order (ROA 21) submitted with the moving papers. The order must be filed with the Secretary of State. Civ. Code § 1798.202(f).
