The Court was
originally scheduled to hear this motion on 8/11/22. Prior to the hearing, it issued a tentative ruling
denying the motion on two grounds. First,
it was concerned about whether Plaintiff’s address had been properly confirmed
or not. Second, it was concerned about
the fast-approaching trial date.
Counsel appeared
at the hearing, and the Court ultimately continued the hearing date to
9/06/22. The Court ordered Counsel to
meet and confer with Plaintiff, and ordered Plaintiff to personally appear at
the continued hearing on 9/06/22.
Thereafter, Counsel filed a
declaration re: meet and confer efforts.
Counsel declares he spoke with Plaintiff on 8/15/22, and Plaintiff is
aware of the ruling and the hearing. Counsel
also declares there is a tentative settlement agreement, which he sent to
Defense Counsel on 8/16/22.
The Court, at the hearing, wishes
to know the status of the settlement agreement.
The Court wishes to hear from Counsel and Plaintiff about whether relief
remains necessary in light of the pending settlement. If relief is necessary, the Court wishes to
hear from all parties about whether continuing the trial date would be
acceptable under the circumstances.
The Court encourages the parties
and attorneys to make arrangements to appear remotely at the hearing.
