1. Motion
to Compel Deposition
On 11/14/22, Defendant filed this motion
to compel Plaintiff’s deposition, contending it had noticed Plaintiff’s deposition
on four occasions, but Plaintiff had failed to attend.
On 12/09/22, Plaintiff filed a “response”
to the motion. Plaintiff indicates he is
hospitalized at Cedars-Sinai. He
indicates he does not oppose being deposed at the hospital, but the hospital is
requiring a court order to allow the deposition. Plaintiff, in his “response,” indicates he
joins in Defendant’s request for relief.
In light of the parties’ agreement
that a deposition should go forward, and in light of Cedars-Sinai’s need for a
court order to allow a deposition to proceed in the hospital, the motion is
granted. Counsel are ordered to meet and
confer forthwith to agree upon a date and time for the deposition to go
forward.
The Court notes that Defendant does
not seek sanctions in connection with the motion, and none are imposed.
2. Case
Management Conference
The parties are reminded that there
is a CMC on calendar today concurrently with the hearing on the above
motion. The Court asks Counsel to make
arrangements to appear remotely at the CMC and hearing on the motion.
