[TENTATIVE] ORDER CONTINUING HEARING ON MOTION TO CONTINUE TRIAL

Dept. S27

8:30 a.m.

October 11, 2022

Moving Party:               Plaintiffs, For Love & Thread Apparel Co., et al.

Opposing Party:           Defendants, Zanpei Xu, et al.

Notice:                         OK

On 9/28/22, the Court granted an ex parte application advancing the hearing on Plaintiffs’ motion to continue the trial date from 11/01/22 to 10/11/22.  Plaintiffs have a motion for leave to file a First Amended Complaint scheduled on 10/20/22.  The Court finds the ruling on the motion for leave will bear on whether or not the motion to continue trial is granted, and therefore the Court continues the hearing on the motion to continue trial to 10/20/22, to be heard concurrently with the motion for leave to amend.

The due date for opposition to the motion for leave to amend remains 10/06/22, as per the 9/28/22 ex parte order.  Any reply to the opposition must be filed per Code, on or before 10/13/22.

Plaintiffs are ordered to give notice.

Parties who intend to submit on this tentative must call the court at 562-256-2227 indicating intention to submit on the tentative as directed by the instructions provided on the court website at www.lacourt.orgIf the department does not receive a phone call indicating the parties are submitting on the tentative and there are no appearances at the hearing, the motion may be placed off calendar.  If a party submits on the tentative, the party’s email must include the case number and must identify the party submitting on the tentative.  If the parties do not submit on the tentative, they should arrange to appear remotely.

Dated this 11th day of October, 2022
