Defendants move to continue the
trial date from 3/20/23 to 4/17/23 due to a lead trial attorney calendar
conflict. Defendants explain that there
were problems connecting to the Court’s virtual system on 10/20/22 when the
Court set the trial date, and the problems led to the scheduling of trial on a
date that was not available on the lead attorney’s calendar.
Any opposition to the motion was
due on or before 12/27/22. No opposition
has been received. Notably, Defendants
provide evidence that Plaintiff agreed to the continuance, but then refused to
sign a formal stipulation. The Court
asks Plaintiff to cooperate with scheduling issues in the future to avoid wasting
party and judicial resources.
The trial date is continued from
3/20/23 to 4/10/23. The FSC is continued
from 3/17/23 to 4/7/23. The expert
witness cut-off is continued to reflect the new trial date, but the discovery
cut-off, which has already passed, is not.
Defendant is ordered to give notice.
Parties who intend to submit
on this tentative must send an email to the court at gdcdepts27@lacourt.org indicating intention to submit on the tentative as
directed by the instructions provided on the court website at www.lacourt.org. If the department
does not receive an email indicating the parties are submitting on the
tentative and there are no appearances at the hearing, the motion may be placed
off calendar. If a party submits on
the tentative, the party’s email must include the case number and must identify
the party submitting on the tentative. If any party does not submit on the
tentative, the party should make arrangements to appear remotely at the hearing
on this matter.
