Judge: Mark C. Kim, Case: 21LBCV00277, Date: 2023-01-10 Tentative Ruling

Case Number: 21LBCV00277    Hearing Date: January 10, 2023    Dept: S27

Defendants move to continue the trial date from 3/20/23 to 4/17/23 due to a lead trial attorney calendar conflict.  Defendants explain that there were problems connecting to the Court’s virtual system on 10/20/22 when the Court set the trial date, and the problems led to the scheduling of trial on a date that was not available on the lead attorney’s calendar.

Any opposition to the motion was due on or before 12/27/22.  No opposition has been received.  Notably, Defendants provide evidence that Plaintiff agreed to the continuance, but then refused to sign a formal stipulation.  The Court asks Plaintiff to cooperate with scheduling issues in the future to avoid wasting party and judicial resources.

The trial date is continued from 3/20/23 to 4/10/23.  The FSC is continued from 3/17/23 to 4/7/23.  The expert witness cut-off is continued to reflect the new trial date, but the discovery cut-off, which has already passed, is not.

Defendant is ordered to give notice.
