On 3/08/22, Defendants filed this motion to seal records, setting it for hearing on 8/04/22.  Defendants’ motion seeks to seal records that have been “submitted for the upcoming receivership hearing.”  The receivership hearing was held between 3/10/22 and 3/14/22.

Pursuant to Savaglio v. Wal-Mart Stores, Inc. (2007) 149 Cal.App.4^th 588, 601, the Court cannot entertain an order sealing documents if the motion is heard AFTER the subject documents are already a matter of public record; failure to obtain the order prior to filing the subject documents waives the right to obtain relief.  The Court therefore denies the motion. 

Defendants are ordered to give notice.

Parties who intend to submit on this tentative must send an email to the court at gdcdepts27@lacourt.org indicating intention to submit on the tentative as directed by the instructions provided on the court website at www.lacourt.org.  If the department does not receive an email indicating the parties are submitting on the tentative and there are no appearances at the hearing, the motion may be placed off calendar.  If a party submits on the tentative, the party’s email must include the case number and must identify the party submitting on the tentative.
