Plaintiff’s attorney seeks to be relieved as counsel.  The Court’s only concern with the moving papers is the signature on the notice of motion and declaration.  The signature is that of Scott Ezzati, Esq.  The Court has no record of Ezzati representing Plaintiff.  The complaint was filed by Thomas F. Nowland, Daniel A. Brodnax, and Analiese S. Danner of the Law Offices of Thomas F. Nowland.  Notably, the notice of motion and declaration indicates that “Law Offices of Thomas F. Nowland” seek to be relieved as counsel.  The caption of the motion does not list Ezzati as an attorney for Plaintiff.  This relationship must be clarified at the hearing. 

 

If the Court is satisfied with the explanation at the hearing, the motion will be granted.  Counsel served Client with the moving papers at a confirmed address, and served all parties to the action with the moving papers.  The time to oppose the motion has passed, and there is no opposition to the motion.  There is currently no scheduled trial date, and the only upcoming hearing date is the 5/24/23 CMC; there will therefore be no prejudice to Plaintiff as a result of the granting of the requested relief.  Relief will be effective upon filing proof of service of the final order on Plaintiff.
