This case appears to arise out of the same set of facts, circumstances, and events that gave rise to 22LBCV00132, which was litigated at length in Department S26 before the Honorable Michael P. Vicencia.  The Court orders Plaintiff to file a Notice of Related Cases pursuant to CRC 3.300(b), which obligates any party with knowledge that a newly-filed case is related to a prior case to file and serve a Notice of Related Case. 

The hearing on this demurrer is continued to 6/06/23, to be heard with Co-Defendant, FK Realty, LLC’s demurrer and the Case Management Conference.  If Department S26 has not ruled on the Notice of Related Cases prior to 6/06/23, the Court will likely continue the hearing on all matters to a future date. 

Defendants are ordered to give notice. 

Parties who intend to submit on this tentative must send an email to the court at gdcdepts27@lacourt.org indicating intention to submit on the tentative as directed by the instructions provided on the court website at www.lacourt.org.  If the department does not receive an email indicating the parties are submitting on the tentative and there are no appearances at the hearing, the motion may be placed off calendar.  If a party submits on the tentative, the party’s email must include the case number and must identify the party submitting on the tentative. If any party does not submit on the tentative, the party should make arrangements to appear remotely at the hearing on this matter.
