TENTATIVE RULING:

 

Plaintiff State Farm Mutual Automobile Insurance Company’s Motion to Vacate Dismissal, Enforce Settlement Agreement and Enter Judgment is PLACED OFF CALENDAR AS MOOT.

 

 

ANALYSIS:

 

Plaintiff State Farm Mutual Automobile Insurance Company (“Plaintiff”) filed the instant action for automobile subrogation against Defendants Vanessa Mariana Sanchez (“Defendant”) and Nancy Sencion on July 24, 2020. Defendant filed an Answer on November 2, 2020 and Nancy Sencion was dismissed from the action on July 15, 2021.

 

On July 28, 2021, Plaintiff filed a copy of its settlement agreement with Defendant with a request for dismissal and retention of jurisdiction under Code of Civil Procedure section 664.4. The Court granted the request for dismissal with retention of jurisdiction on the same date. (Stip and Order for Dismissal, 07/28/21.)

 

Plaintiff filed the instant Motion to Vacate Dismissal, Enforce Settlement and Enter Judgment on January 10, 2023. Plaintiff then filed a proposed order and proposed judgment on January 19, 2023 and January 23, 2023. The Court signed both the proposed order and proposed judgment on the days they were filed. Therefore, the hearing on the instant Motion is PLACED OFF CALENDAR AS MOOT.
