TENTATIVE RULING:

 

Defendant Arkas Zargarian’s Motion to Continue the Trial Date is PLACED OFF CALENDAR.

 

 

ANALYSIS:

 

On November 23, 2020, Plaintiff Mercury Insurance Company (“Plaintiff”) filed the Complaint in this action for automobile subrogation against Defendant Arkas Zargarian (“Defendant”). Defendant answered and filed a Cross-Complaint against Tzvi Schwarzbalm on February 10, 2021. The Cross-Complaint was then dismissed on January 25, 2022.

 

On March 24, 2022, the parties stipulated to continue the trial date from May 23, 2022 to September 20, 2022. Then, the parties stipulated to continue the trial from September 20, 2022 to December 15, 2022. On November 14, 2022, the parties filed a third stipulation to continue the trial date, on which the Court took no action.

 

On November 23, 2022, Defendant simultaneously filed an ex parte application to continue the trial date and the instant noticed Motion to Continue Trial Date. The ex parte application was granted on November 28, 2022, continued the trial from December 15, 2022 to March 7, 2023. (Minute Order, 11/28/22.)

 

Given that the noticed Motion to Continue Trial Date seeks the same relief as the previously granted ex parte application, the noticed Motion to Continue Trial Date is deemed moot and placed off calendar.

 

Conclusion

 

Defendant Arkas Zargarian’s Motion to Continue the Trial Date is PLACED OFF CALENDAR.
