TENTATIVE RULING:

Plaintiff Wang Yang Enterprises, LLC Retirement Account’s Motion to Reset Trial Date or Set Status Conference is GRANTED. STATUS CONFERENCE REGARDING TRIAL DATE IS SET FOR JUNE 22, 2023 AT 8:30 AM IN DEPARTMENT 26 OF THE SPRING STREET COURTHOUSE.

ANALYSIS:

Plaintiff Wang Yang Enterprises, LLC Retirement Account (“Plaintiff”) filed this action against Defendant Robert Gene Henderson (“Defendant”) on January 26, 2021. The First Amended Complaint was filed on April 19, 2022. The action came for trial on March 15, 2023, at which time the parties represented that a settlement had been reached. (Minute Order, 03/15/23.) The Court placed the trial off calendar and set an Order to Show Cause regarding Dismissal (Settlement) for October 10, 2023.

On April 17, 2023, Plaintiff filed the instant Motion to Reset Trial Date or Set Status Conference. No opposition has been filed to date. The motion asks to re-set the matter for trial or set a status conference regarding the trial date on the grounds that the settlement has unraveled. (Motion, Paloci Decl., ¶¶2-5.)

Therefore, Plaintiff Wang Yang Enterprises, LLC Retirement Account’s Motion to Reset Trial Date or Set Status Conference is GRANTED. STATUS CONFERENCE REGARDING TRIAL DATE IS SET FOR JUNE 22, 2023 AT 8:30 AM IN DEPARTMENT 26 OF THE SPRING STREET COURTHOUSE.
