TENTATIVE RULING:

 

Defendant Denise M. Keller’s Motion to Continue the Trial Date is PLACED OFF CALENDAR AS MOOT.

 

 

ANALYSIS:

 

On November 5, 2021, Plaintiffs Antonio Espiritu and Horacio Vasquez Hernandez (“Plaintiffs”) filed the Complaint in this action for motor vehicle negligence against Defendant Denise M. Keller (“Defendant”). No proof of service of the Summons and Complaint has been filed and Defendant answered on December 7, 2022.

 

The parties filed a stipulation to continue the trial date on February 27, 2023, which the Court signed into order on the same date, continuing the trial to November 6, 2023. (Stip and Order, filed 02/27/23.) Defendant then filed the instant Motion to Continue Trial on March 20, 2023.

 

It is unclear why Defendant filed the instant motion to continue the trial date after the stipulation was signed into order. The request for a continuance has been rendered moot by the February 27, 2023 order. Therefore, Defendant Denise M. Keller’s Motion to Continue the Trial Date is PLACED OFF CALENDAR AS MOOT.
