TENTATIVE RULING:

Petitioner Arden Silverman’s Petition to Confirm Arbitration Award is PLACED OFF CALENDAR.

ORDER TO SHOW CAUSE RE DISMISSAL FOR VIOLATION OF LOCAL RULE 3.3(d) IS SET FOR JANAURY 13, 2022 AT 9:30 AM IN DEPARTMENT 26 IN THE SPRING STREET COURTHOUSE.

ANALYSIS:

On May 9, 2022, Petitioner Arden Silverman dba Capital Asset Protection (“Petitioner”) filed the instant Petition to Confirm Arb Award against Respondents Mahaffey Law Group, PC (“Respondent Mahaffey”) and Strategic Business Services, LLC (“Respondent Strategic Business”). On the same date, Petitioner filed a Notice of Related Case with respect to Silverman v. Mahaffey Law Group, PC, et al., LASC Case No. 19STCP01039. The Notice of Related Case, however, was not also filed in the LASC Case No. 19STCP01039, as required by Cal. Rules of Court, rule 3.300(b). LASC Case No. 19STCP01039 is pending in Department 25 in the Spring Street Courthouse.

The instant Petition came for hearing on September 12, 2022 and was continued to December 12, 2022 to allow Petitioner to file the mandatory Notice of Related Case in Department 25. (Minute Order, 09/12/22.) To date, however, no Notice of Related Case has been filed in LASC Case No. 19STCP01039.

Accordingly, Petitioner Arden Silverman’s Petition to Confirm Arbitration Award is PLACED OFF CALENDAR.
