TENTATIVE RULING:       

 

This is an action by Plaintiff Financial Partners Credit Union (“Plaintiff”) against Defendant Christina Tresvant aka Christina D. Tresvant aka Christina Denise Tresvant (“Defendant”) for breach of contract, money had and received, money lent, and account stated. This action is a collections case. California Rules of Court, Rule 3.740, subdivision (a) states that a “ ‘[c]ollections case’ means an action for recovery of money owed in a sum stated to be certain that is not more than $25,000, exclusive of interest and attorney fees, arising from a transaction in which property, services, or money was acquired on credit.” (Cal. Rules of Court, Rule 3.740, subd. (a).) This action arises from a debt owed on a credit account and seeks recovery of a sum certain: $13,601.14. (Compl., ¶¶9, 16, 17, 21.)

 

Accordingly, this matter is transferred to the Norwalk Courthouse, Department SEB. Moving party is to contact department SEB to set a new hearing date for the motion to vacate, with no additional filing fee required.
