TENTATIVE RULING:
Hearing on Disbursement of Funds is PLACED OFF CALENDAR. ANY
UNCLAIMED SURPLUS FUNDS ARE TO ESCHEAT ACCORDING TO LAW.
ANALYSIS:
On March 14, 2022, Plaintiff Fidelity National Title
Company (“Plaintiff”) initiated this interpleader action against Defendants
Mohammad Basith, Rao V. Daluvoy, and Win Chevrolet
Properties, LLC (“Defendants”). This action
arises from a dispute over funds placed in escrow by Defendants Basith and Rao
as purchasers of real property from Defendant Vin Chevrolet in the amount of
$5,000.00. (Compl., ¶¶7-9.) Following their
failure to file responsive pleadings, default was entered against all
Defendants on July 12, 2022.
Plaintiff
filed a Motion to Deposit by Stakeholder, for Discharge of Stakeholder, and Award of Costs and Escrow Compensation, which the Court granted on September 11, 2023.
(Minute Order, 09/11/23.) The Court also set an Order to Show Cause Re:
Disbursement of Funds for December 11, 2023. (Ibid.) Funds of $5,000.00
were deposited by Plaintiff on October 9, 2023.
No response
to the action, nor claims to the funds, have been filed to date. Accordingly,
the Hearing
on Disbursement of Funds is PLACED OFF CALENDAR. ANY UNCLAIMED SURPLUS FUNDS
ARE TO ESCHEAT ACCORDING TO LAW.
