TENTATIVE RULING:

 

Judgment State Farm Mutual Automobile Insurance Company’s Motion to Amend Judgment is GRANTED.

 

 

ANALYSIS:  

 

Judgment Creditor State Farm Mutual Automobile Insurance Company (“Judgment Creditor”) filed the instant action against Judgment Debtor Jaime Salazar aka Jaime Andres Salazar on July 15, 2022. Judgment pursuant to stipulation was entered on April 6, 2023.

 

Judgment Creditor filed the instant Motion to Amend Judgment on March 15, 2024. To date, no opposition has been filed. 

 

Discussion

 

The Motion is brought pursuant to Code of Civil Procedure section 473, subdivision (d), which provides that the court may “correct clerical mistakes in its judgments or orders as entered, so as to conform to the judgment or order directed . . . .” (Code Civ. Proc., § 473, subd. (d).) The judgment was to be entered solely against Judgment Debtor but inadvertently included “and City of Long Beach.” (Motion, Espinosa Decl., ¶¶2-3.) The request to correct the clerical error is hereby granted pursuant to Code of Civil Procedure section 473, subdivision (d). Judgment Creditor proposed amended judgment submitted on March 15, 2024 is signed and entered this date.

 

Conclusion

 

Judgment State Farm Mutual Automobile Insurance Company’s Motion to Amend Judgment is GRANTED.
