Bautista v. Martin, et al.
MOTION
TO VALIDATE PROOF OF SERVICE
(CCP § 415.50)
TENTATIVE RULING:
Plaintiff Andre
Bautista’s Motion to Validate Proof of Services from Case 18STLC01233 and Case
20STLC00670 as Related Cases and to Grant Proof of Service by Email or
Publication is DENIED WITHOUT PREJUDICE TO THE FILING OF SEPARATE, EX PARTE
APPLICATIONS FOR PUBLICATION FOR EACH DEFENDANT.
ANALYSIS:
On August 11, 2022, Plaintiff Andre Bautista (“Plaintiff”) filed the Complaint in this action against
Defendants Gregory J. Martin, Kristos Andrews, and Lany Entertainment LLC (“Defendants”).
On November 18,
2022, Plaintiff filed the instant Motion to Validate Proof of Services
from Case 18STLC01233 and Case 20STLC00670 as Related Cases and to Grant Proof
of Service by Email or Publication. No opposition has been filed to date
It
appears that Plaintiff is requesting the Court order service of Defendants by
publication. (See Motion, p. 3.) The Motion, however, does not indicate for
which Defendants the order for publication is to be made. (Ibid.) If
Plaintiff is requesting an order for service by publication for all Defendants,
separate applications must be made for each. Finally, the Applications for
Publication should be made by ex parte application and not as noticed motions.
Plaintiff is referred to Application for Publication Form LASC LACIV
108.
Therefore, the Motion to
Validate Proof of Services from Case 18STLC01233 and Case 20STLC00670 as
Related Cases and to Grant Proof of Service by Email or Publication is DENIED
WITHOUT PREJUDICE TO THE FILING OF SEPARATE, EX PARTE APPLICATIONS FOR
PUBLICATION FOR EACH DEFENDANT.
