TENTATIVE RULING:

Plaintiff Moldovan, Inc. dba Servicemaster Restoration By Disaster Recovery Experts’ Motion to Compel Responses to Form Interrogatories, Set One, and Request for Sanctions is CONTINUED TO AUGUST 14, 2024 AT 10:00 AM IN DEPARTMENT 26 IN THE SPRING STREET COURTHOUSE. BY JULY 31, 2024, PLAINTIFF IS TO FILE AND SERVE A SUPPLEMENTAL DECLARATION WITH THE MISSING EXHIBITS. FAILURE TO DO SO MAY RESULT IN THE MOTION BEING DENIED.

ANALYSIS:

On August 4, 2023, Plaintiff Moldovan, Inc. dba Servicemaster Restoration By Disaster Recovery Experts (“Plaintiff”) filed the instant action against Defendant Alfreda V. Adger (“Defendant”). Defendant filed an answer on September 12, 2023.

Plaintiff filed the instant Motion to Compel Responses to Form Interrogatories and Request for Sanctions on March 29, 2024. The Motion contends that Plaintiff served Form Interrogatories, Set One, on Defendant on January 23, 2024. (Motion, Tovar Decl., ¶4.) No copy of the discovery requests are attached to the supporting declaration as claimed, however. (Ibid.) Accordingly, the hearing is continued to allow Plaintiff to file a supplemental declaration with the missing exhibits attached.
