TENTATIVE RULING:
Expedited
Petition to Approve Minor’s Compromise of Disputed Claim on behalf of Plaintiff
Bohdan Bahlaievskyi is DENIED.
ANALYSIS:
On June 26, 2023, Plaintiff Bohdan
Bahlaievskyi (“Plaintiff”) filed the instant action against Defendant Janet
Petrosian (“Defendant”) for motor vehicle negligence. When Defendant failed to
file a responsive pleading, Plaintiff obtained their default on October 11,
2023. On April 30, 2024, the Court denied Defendant’s Motion to Vacate Default.
(Minute Order, 04/30/24.)
On May 28, 2024, non-party
Petitioner Natalya Kocheshevia (“Petitioner”) filed an Expedited Petition to
Approve Compromise of Pending Action on behalf of Claimant Bohdan Bahlaievskyi
/ Plaintiff. On August 19, 2024, the Court issued an order regarding the
Expedited Petition that documented numerous problems. (Minute Order, 08/19/24.)
Petitioner was ordered to file papers correcting the defects by October 24,
2024 and was warned that failure to do so might result in the Expedited
Petition being denied. (Ibid.) To date, no additional papers have been
filed.
Conclusion
Therefore,
the Expedited Petition to Approve Minor’s Compromise of Disputed
Claim on behalf of Plaintiff Bohdan Bahlaievskyi is DENIED.
