TENTATIVE RULING:

Defendants Future Age Enterprises, Inc. dba Ace Realty and Cedric Age’s Demurrer to the Complaint is PLACED OFF CALENDAR.

ANALYSIS:

Plaintiff KMC Landscaping, Inc. (“Plaintiff”), in propria persona, filed the instant action against Defendants Future Age Enterprises, Inc. dba Ace Realty (erroneously sued as Ace Realty) and Cedric Age (“Defendants”) on September 29, 2023. Defendants filed the instant Demurrer to the Complaint on November 21, 2023. Defendants filed a notice of non-opposition on December 26, 2023. The Demurrer initially came for hearing on January 4, 2024, at which time the Court noted Plaintiff, a corporation, improperly filed the action in propria persona, through a non-lawyer. (Minute Order, 01/04/24.) The court continued the hearing on the Demurrer and ordered Plaintiff to file a substitution of attorney demonstrating it is represented by a licensed California attorney by March 6, 2024. (Ibid.) The Court also set an order to show cause regarding striking Plaintiff’s Complaint as improper for March 27, 2024. (Ibid.) To date, Plaintiff has not filed a substitution of attorney as ordered, nor filed any other papers.

Therefore, Defendants Future Age Enterprises, Inc. dba Ace Realty and Cedric Age’s Demurrer to the Complaint is PLACED OFF CALENDAR.
