TENTATIVE RULING:

Plaintiff Haroun Bacchus’ Motion to Strike Memorandum of Costs, or in the alternative, Tax Costs, is PLACED OFF CALENDAR.

ANALYSIS: 

On January 30, 2015, Plaintiff Haroun Bacchus (“Plaintiff”) filed this action against Defendants Misty Thomson and Alexander Yerkes (collectively, “Defendants”). The operative Second Amended Complaint (“FAC”) was filed on November 13, 2018. Following a court trial, judgment was entered against Plaintiff on December 17, 2019. Plaintiff’s Motions for New Trial and Reconsideration were subsequently denied. On February 25 and 26, 2020, Plaintiff filed appeals of the judgment and post-judgment decisions. The appeals have been denied or dismissed. (Remitturs, filed April 11, 2022 and June 30, 2022.)

Plaintiff filed the instant Motion to Strike Memorandum of Costs, or in the alternative, to Tax Costs, on May 2, 2022. No opposition has been filed to date.

The Motion is brought with respect to a Memorandum of Costs dated April 5, 2022, which was served on Plaintiff on April 11, 2022. (Motion, Bacchus Decl., ¶2.) However, no such Memorandum of Costs was filed with the Court. Memoranda of Costs have only been filed with the Court on January 6, 2022, February 25, 2020, and March 11, 2020. Therefore, no Memorandum of Costs pertaining to the instant Motion has been filed with the Court.
