Judge: Mark H. Epstein, Case: 19SMCV01626, Date: 2023-01-12 Tentative Ruling
Case Number: 19SMCV01626 Hearing Date: January 12, 2023 Dept: R
The court has reviewed the most recent iteration of the
proposed judgment. It appears that the
Nevada court has agreed that this court may adjudicate the issues that relate
to property currently in Nevada. Given
that, and with the caveat that the court wants to be sure that there is nothing
in Florida that is inconsistent with the judgment, the judgment appears to be
proper and the court is tentatively inclined to sign it. However, the amount of damages must be shown
per the court’s earlier order. Thus, the
court is prepared to award the amounts set forth in the Doverspike declaration
except for the amounts in paragraphs 136-140.
For those amounts, the court is not convinced that the amount claimed is
justified. The court will award $50,000
for those items.
Counsel will prepare a revised judgment including those amounts and any updates to prejudgment interest with a declaration describing the calculations therefor. Counsel should send it to Mr. Allen and, unless the order relieving him as counsel has become effective, to Mr. King as well. The court will sign a revised judgment without further hearing unless proper objections are lodged thereto.
