The court will discuss this with counsel, assuming, that is,
that they cannot work out between them a date for the Hankey deposition. The court would expect the parties—each
represented by competent counsel—to be able to solve this problem without
judicial intervention. But if such
intervention is needed, the court will issue an appropriate order. The court will also inquire as to what efforts
the parties made to re-schedule the deposition without the need for court
intervention. The court recognizes that
counsel are busy with this and other matters.
