Judge: Mark H. Epstein, Case: 22SMCV00598, Date: 2023-04-07 Tentative Ruling
Case Number: 22SMCV00598 Hearing Date: April 7, 2023 Dept: R
The motion to seal is GRANTED. However, this is without prejudice to any
member of the press or public bringing a motion to unseal all or some of the
sealed documents. Should such a motion
be brought, the moving parties (or any other party affected by the sealing
order) may oppose such a motion. The
court does find that the moving parties have demonstrated that there is a
protectable interest in private information, that filing the documents in
question in the public record will vitiate that interest and need for privacy,
that the public’s right to see the information does not, at least on this
record, overcome the interest in confidentiality, that there is no less
restrictive way to protect the interests in privacy that have been
demonstrated, and that the sealing order is narrowly tailored to meet its
objectives.
