The matter is here for an FSC. The FMC order was given on May 10, 2023,
however the court has not received any FSC papers. The court suspects that this might be because
the case settled, which would be an excellent reason, and the court recalls
that the parties were going into mediation.
That is how it appears in that there was a request for dismissal
filed. (It was rejected because
cross-complainant’s counsel must also sign and then a later dismissal was
rejected because it dismissed the cross complaint rather than the operative
amended cross complaint.) It would
appear that the matter has settled and that all that remains is to file the
papers in proper form. Therefore, the
trial date is VACATED and the court will set an OSC re: Dismissal (Settlement)
for about 60 days out with no appearances necessary if the matter is dismissed
prior to that time. If the parties so
desire, the court will dismiss the entire action today on oral motion by both
parties.
