This is a motion to continue trial and it is unopposed. The court generally does not like motions to
continue property. However, there is a
separate action by the carrier to rescind the policy that is now pending in
federal court. The parties persuasively
argue that holding a trial in the instant case while that case is pending makes
no sense. Accordingly, the motion is
GRANTED. The FSC and trial dates are
VACATED. The court will set a TSC in
about 6 months or so, and will discuss a specific date with the parties.
