The court is inclined to DENY the application.  The trial date was set on December 26, 2023—over a year ago and 18 months before trial.  There has been no showing of diligence.  As to trial counsel’s conflicts, the court does not know how that happened.  The trial dates were agreed upon by the parties; the court expected that counsel would not schedule something to conflict with a date it promised the court and if another court attempted to do the same, that counsel would have brought this to that court’s attention.
