The Court has reviewed Plaintiff’s ex parte application to shorten time to hear defendant’s demurrer, or in the alternative, to hear demurrer at the time of the ex parte application.  The Court has also reviewed Defendant’s demurrer and Plaintiff’s opposition to the demurrer.  The Court rules from chambers without oral argument as follows.  The ex parte application is GRANTED, and the demurrer will be heard forthwith.  The Court will hear oral argument as to the demurrer, but the Court’s tentative is to OVERRULE the demurrer and order Defendant to answer only within 5 days.
