If the court’s current trial has resolved, then the
application is CONTINUED. Counsel for GM
is a busy person. But when the court set
the trial date a year ago, none of these conflicts were brought to the court’s
attention. The fact that counsel booked
six trials at the same time is not this court’s problem. Had counsel informed the court of the other
five trials when this one was set, the court likely would have set a different
day.
It might turn out that the court is otherwise engaged in
trial on the present trial date. If so,
then the court will grant the continuance.
But for now, it just appears that counsel over-booked and waited until a
few weeks before trial to tell the court about it. That is not good cause. The court also notes that if the matter is
continued, the court makes no promises as to when it will be restored to the
trial calendar. The court will hear the
matter one week from today. But the
court notes that the parties should not assume that the matter will be
granted—it depends on whether the current case is still in progress. The parties are welcome to check in daily to
see how the case is doing.
