The court will discuss the matter with counsel.  In particular, the court will want to know: (1) why the dates that CAA proposed and that Respondents accepted for the hearing on the petition before this court were not accepted; (2) whether respondents will agree to the confidentiality order CAA proposed that is in effect in the arbitration (and if they will so agree, whether this court should enter an order immediately to that effect to allow CAA to serve unredacted documents on respondents); (3) whether CAA believes that it can file a petition and seek relief in this court without given Respondents an unredacted copy of the petition; (4) why respondents’ willingness to agree to a hearing date as proposed by CAA was not mentioned in the ex parte papers.

 

Having said all of that, the court is inclined to set the hearing on the dates CAA initially proposed and to which respondents agreed.  The court would also like the parties to meet and confer and see if they will agree to the entry of an order by this court directing respondents to comply with the subpoenae subject to any objections that respondents might bring that that are sustained by the JAMS arbitration panel, thereby obviating the need for any hearing at all in this court unless respondents refuse to honor the subpoenae after the JAMS panel has passed on any objections.
