The motion to tax costs is GRANTED IN PART AND DENIED IN PART.  The court agrees with plaintiff that the mediation fees are not properly included as recoverable fees.  The same is true of the transcripts.  Accordingly, the motion is GRANTED in the amount of $4294.75, meaning that the claimed costs are taxed (i.e., reduced) by that amount.  The motion is otherwise DENIED.

The court notes that plaintiff just filed a new motion to tax costs.  It does not really appear to be a motion to tax costs; it is really a motion to take some action because defendant purportedly lied a lot.  That seems more a motion for a new trial or maybe for a JNOV.  The time to bring those motions has long passed and the court will not consider them.  The new motion is therefore STRICKEN on the court’s own motion.
