The motion to enforce is GRANTED.

Trial began in this case some time ago.  After the first day of trial, the parties settled.  The settlement was placed on the record in open court save for one party, who later confirmed agreement to the settlement terms.  On October 20, 2022, the court heard plaintiff’s motion to enforce the settlement.  The court was prepared to grant the motion then, but defendant stated that the check was in the proverbial mail, leaving only an issue of interest that the parties suggested could be easily resolved.  The key term was that Dreamhammer was to pay Kantor $50,000 within a year of the settlement.  If it was paid, that would end the case.  If not, judgment could be entered against Dreamhammer for the $50,000 and the case reinstated against the other defendants.

The court has received no word as to the case’s status since the prior hearing.  If the check has been received, the court presumes plaintiff will withdraw the motion.  If not, the court intends to grant the motion and sign the proposed judgment, lodged on September 8, 2022, and to which no objection was raised.
