The Court is not happy about this. The case is over four years old. The problem seems to be that plaintiff’s
deposition is not concluded.
Neither party has moved with anything like diligence here. The fact is that literally months went by with nothing being done. Finally, at the last minute, defendant re-asserted the need to complete the deposition but plaintiff was not available. The trial has already been moved.
The court would normally deny the motion and proceed to consider whether the case ought to go forward as is or simply be dismissed for failure to bring it to trial. But, as it turns out, the court has another likely trial set for 12/19/22. For that reason, and that reason alone, the court will grant the motion and continue the trial one last time. The next available date will likely be June. There will be no further continuances.
