The matter is here again for a Final Status Conference.  And again, materials have not been filed.

The court is therefore inclined to dismiss the action for failure to follow court rules or to set a hearing to dismiss the matter for failure to prosecute pursuant to CCP section 583.410 et seq. or set a hearing to strike the answer and enter default for failure to follow court rules.  The trial date is vacated.

As the court stated last time, it is plain from the docket that neither party has an interest in litigating.  The court suggested that, given that situation, they settle.  The court has not seen any settlement materials, but neither has the court seen any movement toward being ready for trial.  The time has come to end this case, one way or the other.
