Motion to Amend Judgment

Defendant Evan Musikantow’s motion to amend the Court’s September 20, 2016 Judgment in this action to remove Defendant Nicole Zuber (“Zuber”) from the Judgment is DENIED. 

First, Defendant has no standing to assert relief on behalf of another defendant/judgment debtor. 

Second, Defendant has not provided any legitimate, legal basis to remove Nicole Zuber from the default Judgment entered against her.

Defendant erroneously suggests Defendant Zuber was not originally listed on the Judgment entered by the Court, and that sometime after the Judgment was entered, a clerk somehow erroneously added her onto the Judgment. 

The Court file shows that is not what happened.  In fact, the September 20, 2016 Judgment signed by the Court shows on its face that it was entered against Defendant Evan Musikantow and the other defendants listed on Attachment 5a, one of whom is Nicole Zuber. Thus, Defendant Zuber was not “added onto” the judgment later by a clerical error; she was named in the Judgment when it was signed and entered by the Court.

Clerk is ordered to give notice.
