Defendant/Cross-Complainant Mike Booth (“Booth”) seeks a determination that the settlement he reached with Plaintiffs Michael Doutt and Amber Kriens-Doutt was made in good faith within the meaning of Code of Civil Procedure (“CCP”) section 877.6. The Motion is GRANTED.
The Court finds Booth substantially complied with CRC Rule 3.1382. Booth met his burden to show the settlement was entered in good faith, along with a description of the case. (McDermott 5/4 Decl., ¶¶ 3, 5-14 and 16.) The Motion was not opposed.
The Court finds Booth’s settlement with Plaintiffs was made in good faith. This determination shall bar any other joint tortfeasor or co-obligor from any further claims against Booth for equitable comparative contribution, or partial or comparative indemnity, based on comparative negligence or comparative fault.
The Case Management Conference is continued to 9/18/2023 at 1:30 p.m. in this Department to coincide with the hearing on the pending Motion for Leave to File Cross-Complaint.
Booth is ordered to give notice of these rulings.
