Motion for Attorney Fees

The Motion by Defendants Phillip Bellafaire and Semit Properties, LLC (“Defendants”) for an award of attorneys’ fees against Plaintiff Hipolito Lopez (“Plaintiff”) under Government Code section 12965(c)(6) is continued to 9/19/22 at 1:30 p.m., to be heard in conjunction with Plaintiff’s motion to strike Defendants’ memorandum of costs.

The Court notes that with his motion to strike, Plaintiff raises the issue of his inability to pay.  [ROA ##537, 543.]

“[A] plaintiff's ability to pay must be considered before awarding attorney fees in favor of the defendant.”  Villanueva v. City of Colton, 160 Cal.App.4th 1188, 1203.

Defendants are ordered to give notice.
