The Motion by Defendant Orange County Global Medical Center, Inc.(#Defendant”) to compel each of Plaintiffs, Rose Mary George-Ann Finocchi, Joshua Joseph Conley, Daniel Paul Finocchi, Travis Finocchi, and Angela Finocchi, (Collectively “Plaintiff”) to provide verified responses to Form Interrogatories, Set One, is GRANTED.
Defendant’s motion to compel each of Plaintiffs to provide verified responses to Special Interrogatories, Set One, is also GRANTED.
Defendant’s motion to compel each of Plaintiffs to provide verified responses to Requests for Production, Set One, is GRANTED
Defendant is awarded sanctions of $855 against Plaintiffs and their counsel. Sanctions are to be paid within 30 days.
Motions to Compel Responses to Interrogatories
If a party to whom interrogatories are directed fails to serve a timely response: (1) the party who has failed to provide a timely response waives any right to exercise his right to produce writings under section 2030.230; and (2) the party propounding the interrogatories may move for an order compelling response to the interrogatories. Code Civ. Proc. § 2030.290(a) and (b).
Here, the two sets of interrogatories – form and special – were properly served on each of the Plaintiffs. [Paggabao Decls. ¶¶ 3-4 and Exhibit B.] So, too, were the motions to compel. Plaintiffs did not respond to the interrogatories and have not opposed the motions.
Defendant is entitled to orders compelling Plaintiffs’ responses without objection. Code Civ. Proc. § 2030.290.
Accordingly, Defendant’s motions to compel responses to the form and special interrogatories served on each Plaintiff are granted.
Motions to Compel Responses to Requests for Production
A party’s failure timely to respond to requests for production waives any objection to the requests. Code Civ. Proc. § 2031.300(a).
Where no response to request for production of documents has been served, the propounding party may move to compel responses. Code Civ. Proc. § 2031.300(b). No prior meet and confer is required; nor is any showing of good cause. Id. (compare Code Civ. Proc. § 2031.310(b)).
Again, the requests for production were properly served on each of the Plaintiffs. [Paggabao Decl. ¶¶ 3-4 and Exhibit B.] So, too, were the motions to compel. Plaintiffs did not respond to the requests for production and have not opposed the motions to compel responses.
Accordingly, Defendant’s motion to compel responses by each of Plaintiffs to the requests for production is granted.
Defendant is ordered to give notice.
