Motion to Compel Production

The hearing on the motion by Defendant Santa Ana Unified School District (“Defendant”) to compel compliance with subpoena for production of Plaintiff’s psychotherapy records, is continued to 12/05/22 at 1:30 PM in Department C31.

The proof of service does not reflect personal service of the moving papers on the non-party deponent, Suzanne Simpson, Ph.D., as required by Rule of Court 3.1346. (ROA 76, 84.) Defendant is ordered to file a proof of service, at least 5 court days before the continued hearing date, showing personal service on the deponent, per the timing provisions of the Code. (Cal. R. Ct. Rule 3.1300(c).)

Defendant is ordered to give notice of this ruling, including notice to the non-party deponent.
