Motion to be Relieved as Counsel

The Motion to be Relieved brought by Bruce M. Bunch (“Counsel”), counsel for Frank Fischer, is GRANTED, as counsel fully complied with the requirements articulated in CRC 3.1362.  Additionally, as counsel indicates there has been an “irreparable breakdown” in the attorney client relationship, relief is appropriate.  However, Counsel must submit a revised Proposed Order to reflect the current dates, times, and locations for the mandatory settlement conference (9/1/23) and trial (9/25/23.)

Counsel is ordered to give notice to all parties, including Plaintiff Frank Fischer.

Motion to be Relieved as Counsel

The Motion to be Relieved brought by Bruce M. Bunch (“Counsel”), counsel for Plaintiff Ioanna Fischer, is CONTINUED to June 5, 2023 at 1:30 p.m. in Department C31.

This motion initially came up for hearing on May 8^th, 2023.  At that time, given the service of conflicting notices and to avoid confusion, the Court continued this hearing to May 15, 2023. (ROA No. 79.)  The Court ordered Plaintiff’s counsel to give notice to Plaintiffs and all parties. (Id.) 

Plaintiff’s Counsel did not submit a Proof of Service that demonstrates compliance with the above order.  Consequently, because it appears that defense counsel and Plaintiff Ioanna Fischer did not receive notice of this hearing, the hearing is continued to June 5, 2023, at 1:30 p.m. in Department C31.

Counsel is again ordered to give notice to all parties, including Plaintiff Ionna Fischer.
