Motion to Be Relieved as Counsel of Record -- CONTINUED

The Motion by Sands Law Group, by Thomas Sands (“Counsel”), attorney for Defendant RTR Industries, LLC (“Defendant RTR”), for an order relieving it as counsel for Defendant RTR  is continued to August 28, 2023 at 1:30 p.m. in this Department, for Counsel to (i) serve Defendant RTR and the other parties and/or file a proper proof of service showing it has already done so; and (ii) submit and serve an updated proposed order.

There is no proof of service on Defendant RTR or on Plaintiff On Deck Capital, Inc. in the Court’s file.  CRC 3.1300(c). The only proof of service filed by Counsel shows service on Thomas Nguyen at a single address.  [ROA #59.]  There is no reference to RTR Industries on the proof of service.  The proof of service must show which parties were served, and what papers each was served with.

Further, it appears Counsel may have intended to seek leave to withdraw as to Defendant Thomas Nguyen, as Counsel filed a declaration and proposed order as to Defendant Nguyen.  See ROA ## 61, 69.  However, there is no motion for counsel to be relieved as to Defendant Nguyen on calendar – for this date or any other.
