Motion to be Relieved as Counsel of Record

The Motion by Edward W. Freedman, counsel of record for Defendant CommWave, Inc. (“CommWave”), for an order relieving him as counsel for Defendant CommWave is GRANTED.  Moving party is ordered to give notice.

The Court will sign the order relieving counsel.  Counsel is cautioned that the order relieving counsel will NOT be effective until the filing of a proper proof of service of the signed order upon on Defendant CommWave and all other parties.

Defendant CommWave may only appear in this action through counsel.  CLD Construction, Inc. v. City of San Ramon (2004) 120 Cal.App.4th 1141, 1145.  To continue to defend the action, CommWave must obtain new counsel.

Trial is set for 10/23/23.  Accordingly, an order to show cause re striking CommWave’s Answer and entering default is set for August 28, 2023, at 9:00 a.m. in Dept. C31, should CommWave fail to obtain new counsel.  The Court sets a Status Conference for that same  date and time.
